Abstract

In the orthodox patriarchal society women are treated as an object and thus are subjected to a lot of cruelty. In present time society has become progressive and modern. The condition of women has improved a lot in almost and each and every sphere but however domestic violence is still persistence. Every woman has her own story to keep silence in spite of facing extreme form of violence in her own home. There are various reasons behind the growing menace of violence within the four walls. India has specific legislation dedicated towards the domestic violence and the name of that legislation is “The Protection of Women from Domestic Violence Act 2005”. This is the primary legislation dealing with the offence of domestic violence in India. However apart from this, Indian constitution, Indian penal code and other statutory laws has provision that takes into account the specific elements of the domestic violence. In this research work in depth analysis is made to understand the entire concept of domestic violence. This research work makes an effort to study as to why domestic abuse is still persistent in present time when women are socially as well as legally empowered. Laws relating to the domestic violence are studied critically to provide a comprehensive understanding to the reader. Overall, this research work is a comprehensive study to understand the legal dynamics of domestic violence in India.
